Terms of Service.

01Who may use the Services

You must be legally capable of entering into this agreement to use the Services. If the law where you live requires you to be older than the published minimum age, or requires consent from a parent or legal guardian, that law applies.

If you use the Services for an organization, you represent that you have authority to bind that organization; in that case, "you" includes the organization. The Services are not available to anyone who is prohibited from using them under applicable law or whose account we have previously terminated for violating these Terms, unless Work-Built gives written permission.

02The Work-Built Services

Work-Built is designed to provide structured fitness training, including authored programs, workouts, exercise guidance, training schedules, progress tracking, educational content, challenges, achievements, and community features. The exact features available to you depend on the released product, your account, location, device, and feature entitlements.

Some features described in marketing materials, previews, documentation, or these Terms may not yet be available. We do not promise a particular release date, feature set, program, workout, content item, challenge, community function, integration, or continued availability.

03Fitness, health, and safety

Not medical or emergency services

Work-Built provides general fitness, training, and educational information. The Services do not provide medical advice, diagnosis, treatment, rehabilitation, emergency monitoring, or a substitute for care from a qualified healthcare professional. Work-Built does not create a doctor-patient, therapist-patient, trainer-client, fiduciary, or other professional healthcare relationship.

If you believe you are experiencing a medical emergency, stop using the Services and contact local emergency services immediately.

Your responsibility before and during training

Exercise involves inherent risks, including overexertion, falls, equipment failure, illness, serious injury, and death. Your condition, experience, environment, equipment, and ability may affect whether an activity is appropriate for you.

Before beginning or changing an exercise program, you are responsible for determining whether you should consult a qualified healthcare professional. You are responsible for selecting appropriate exercises, loads, repetitions, distances, durations, intensity, scaling options, and equipment; using safe technique; inspecting your equipment and training area; following equipment-manufacturer instructions; and stopping when continuing would be unsafe.

Do not disregard professional medical advice or delay seeking it because of information provided through the Services. If instructions from a qualified healthcare professional conflict with the Services, follow the professional's instructions.

No guaranteed outcome

Training outcomes vary. Work-Built does not guarantee improvements in strength, conditioning, endurance, readiness, body composition, weight, health, injury prevention, occupational performance, selection outcomes, or any other result. Past performance, testimonials, achievements, rankings, and other users' results do not guarantee your results.

Occupational and service use

Unless expressly stated in a separate written agreement, Work-Built is not an official program of, endorsed by, or affiliated with any military unit, government agency, law-enforcement agency, fire or emergency service, employer, certifying body, or selection authority. The Services do not replace official policy, required instruction, duty-specific training, professional certification, medical clearance, or the directions of your employer or command.

Work-Built achievements, streaks, challenge rankings, and program certificates recognize activity within the Services. They are not academic degrees, professional certifications, licenses, medical records, official fitness-test results, or proof of occupational qualification.

04Accounts and account security

You agree to provide accurate, current, and complete account information and to keep it updated. You may not impersonate another person, create an account for someone without authority, transfer or sell your account, share credentials in a way that compromises security, or use another person's account without permission.

You are responsible for activity performed through your account to the extent permitted by law. Keep your credentials confidential, use available security features, and notify us promptly through the support route published with these Terms if you suspect unauthorized access.

We may require identity, account, or eligibility verification. You agree not to circumvent authentication, authorization, entitlements, access restrictions, rate limits, or other safeguards.

05Profiles and training information

You control the information you choose to add to your profile, subject to required fields and these Terms. Profile controls may allow a profile to be public, visible to members, or private. Review your settings before posting or interacting.

Training preferences, schedules, workout records, notes, performance results, personal records, content progress, challenge progress, and similar information depend partly on information you enter and actions you record. You are responsible for reviewing that information for accuracy before relying on it. Work-Built may correct clear technical errors but does not guarantee that user-entered or calculated information is accurate or complete.

06Early access and preview features

Submitting an early-access application does not guarantee selection, account creation, access, a response, a release date, or continued participation. We may approve, reject, prioritize, or stop reviewing applications based on lawful product and operational criteria.

Early-access, beta, experimental, or preview features may be incomplete, unavailable, changed, or withdrawn. They may contain errors and may not preserve data in the same way as generally available features. Unless a separate written agreement states otherwise, preview participation is voluntary and provided without a service-level commitment.

Marketing consent is optional and separate from an early-access decision. You may withdraw marketing consent as described in our Privacy Policy or through the unsubscribe method provided in marketing communications.

If a preview requires confidentiality, testing obligations, or special data terms, we will present a separate agreement before those obligations apply.

07Service-eligibility verification

Where available, Work-Built may use a third-party provider or manual process to verify eligibility associated with military service, veteran status, law enforcement, or first-responder service.

You agree to submit only accurate information about your own status and not to falsify, alter, misuse, or obtain another person's verification information. A verification decision does not guarantee any particular benefit, price, feature, or duration unless the applicable offer expressly states those terms.

Verification providers may apply their own terms and privacy policies. Work-Built may deny, expire, or revoke verification or an associated entitlement if information is inaccurate, eligibility ends, the provider withdraws confirmation, the offer ends, or misuse is suspected, subject to applicable law.

08Community and messaging

Community features may include profiles, posts, forums, comments, reactions, challenge participation, teams, attachments, and direct messages. You are responsible for your conduct and for content you submit, send, or make available through the Services ("User Content").

Community rules

You may not use the Services to:

• Violate a law, regulation, court order, or another person's rights
• Threaten, harass, stalk, exploit, or abuse another person
• Promote hatred or violence against a person or protected group
• Post sexual exploitation material or any sexual content involving a minor
• Encourage dangerous conduct in a way that creates an unreasonable risk of harm
• Impersonate another person or misrepresent an affiliation, qualification, service status, result, or endorsement
• Post content that is defamatory, fraudulent, deceptive, invasive of privacy, or unlawfully discriminatory
• Infringe copyright, trademark, publicity, privacy, or other proprietary rights
• Send spam, unauthorized promotions, chain messages, scams, or malware
• Collect, scrape, index, or harvest information about users except through functionality we expressly provide and permit
• Reveal another person's private or sensitive information without lawful authority
• Manipulate reactions, rankings, challenges, achievements, reports, or other product signals
• Coordinate false reports, evade blocks or moderation actions, or create accounts to continue prohibited conduct
• Interfere with, overload, probe, disrupt, or compromise the Services or another user's experience
• Help or encourage another person to do any of the above

Additional community guidelines may apply if they are presented through the Services.

Public and private interactions

Public and member-visible User Content may be seen, copied, or reshared by others. Direct messages are intended for their participants, but they are not guaranteed to be confidential from Work-Built. We and our service providers may access, preserve, or disclose messages when reasonably necessary to operate the feature, investigate a report, enforce these Terms, protect users or others, or comply with law, as described in our Privacy Policy.

Blocking may restrict future interactions but does not necessarily delete earlier messages, posts, reports, or safety records. Removing or editing content may change what others see without immediately erasing every stored copy, including backups or records retained for safety or legal reasons.

09User Content

Ownership

As between you and Work-Built, you retain ownership of User Content that you create and have rights to. You represent and warrant that you have all rights and permissions needed to submit the User Content and grant the licenses in these Terms, and that our permitted use will not violate any law or another person's rights.

License needed to operate the Services

When you submit User Content, you grant Work-Built a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, format, adapt for technical purposes, and otherwise use that User Content only as reasonably necessary to operate, provide, secure, moderate, and improve the Services; comply with your settings and instructions; and meet legal obligations. This license allows us to use service providers acting on our behalf and to make public or member-visible content available according to the feature and your settings.

This license does not give Work-Built permission to use private messages or private-profile content in public advertising. Any use of your name, likeness, testimonial, or results in Work-Built marketing requires separate permission where required by law.

The license ends when the User Content is deleted from our active systems, except to the extent that continued retention or use is reasonably necessary for backups, security, moderation, legal compliance, dispute resolution, enforcing agreements, protecting rights, or content others have lawfully copied or reshared outside our control.

Feedback

If you voluntarily provide ideas, suggestions, or feedback about Work-Built, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use it without restriction or compensation. This does not transfer ownership of your User Content or permit us to identify you in marketing without any permission required by law.

10Work-Built content and intellectual property

The Services, including their software, design, branding, programs, workout structures, exercise instructions, videos, images, articles, and other content supplied by Work-Built or its licensors ("Work-Built Content"), are protected by intellectual-property and other laws.

Subject to these Terms and your applicable feature access, Work-Built grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use Work-Built Content for your own lawful, non-commercial use through the Services.

Unless Work-Built gives written permission or applicable law allows it, you may not copy, reproduce, distribute, sell, license, publicly display, commercially exploit, create derivative works from, remove rights notices from, or systematically extract Work-Built Content.

You may not reverse engineer, decompile, or attempt to derive source code from the Services except to the limited extent a restriction is prohibited by law. No rights are granted by implication. Work-Built and its licensors retain all rights not expressly granted.

11Copyright complaints

If you believe User Content infringes your copyright, send a written notice to our designated copyright agent containing the information required by applicable law, including identification of the work, identification and location of the material, your contact information, the required good-faith and accuracy statements, and your physical or electronic signature.

We may remove or restrict allegedly infringing material and, where appropriate, terminate repeat infringers. We may send a copy of a notice to the user who submitted the material. If your material was removed by mistake or misidentification, you may submit a legally compliant counter-notification to the designated agent.

12Feature access and paid services

Work-Built may grant, limit, expire, or revoke access to features through entitlements associated with an account, offer, promotion, verification decision, or other approved source. You may not transfer, resell, duplicate, or misuse an entitlement.

Work-Built does not currently define consumer subscription plans, prices, renewals, trials, payment methods, refunds, or cancellation rules, and must not charge you based only on these Terms.

Before offering a paid service, Work-Built must clearly disclose and obtain agreement to the price, currency, taxes, billing frequency, term, automatic renewal, trial conversion, payment authorization, cancellation method, refund policy, and any offer-specific conditions at the point of purchase.

13Third-party services

The Services may contain links to or integrations with third-party services, content, devices, or verification providers. Work-Built does not control third-party services and is not responsible for their content, availability, security, or practices. Their terms and privacy policies govern your relationship with them.

The presence of a link or integration does not imply endorsement. Your use of third-party services is at your own risk, subject to rights that cannot lawfully be waived.

14Moderation and enforcement

Work-Built may investigate suspected violations and may remove or restrict content; limit features; expire or revoke entitlements; issue warnings; or suspend or terminate accounts when we reasonably believe action is necessary to enforce these Terms, protect the Services or users, comply with law, or address security, fraud, or abuse.

We are not obligated to monitor all content or communications, and moderation does not guarantee that objectionable or harmful content will be removed immediately or at all. Moderation decisions may depend on context and available evidence.

Where required by law or provided by policy, we will give notice and an opportunity to appeal. We may withhold notice where doing so would be unlawful, compromise an investigation or security, expose another person to risk, or enable further abuse.

15Your account closure

You may stop using the Services at any time and may request account closure through the route published with these Terms. Account closure does not automatically require deletion of every record. We may retain information as described in the Privacy Policy, including where needed for legal compliance, safety, fraud prevention, disputes, enforcement, backups, or the rights of others.

Provisions that by their nature should survive account closure or termination will survive, including provisions concerning ownership, licenses already exercised, feedback, legal compliance, disclaimers, liability, indemnity, disputes, and general contract terms.

16Changes, availability, and updates

We may update, add, limit, suspend, or discontinue all or part of the Services. Where required by law, we will provide notice before a change materially affects your rights or paid access.

Software updates may be required for continued use, security, or compatibility. You are responsible for maintaining a compatible device, operating system, network connection, and any third-party charges associated with them.

We may schedule maintenance or experience outages. Unless a separate written service-level agreement applies, we do not guarantee uninterrupted, error-free, or permanently available Services.

17Disclaimers

Nothing in these Terms excludes a warranty, guarantee, condition, remedy, or right that cannot lawfully be excluded.

To the fullest extent permitted by law, the Services and Work-Built Content are provided "as is" and "as available." Work-Built and its affiliates, licensors, and service providers disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, and warranties arising from course of dealing or usage of trade.

We do not warrant that the Services will be uninterrupted, secure, accurate, complete, current, compatible with your equipment, or free of harmful components, or that content, training, personalization, moderation, verification, or results will meet your expectations.

18Limitation of liability

Nothing in these Terms limits liability that cannot lawfully be limited, including liability where an exclusion is prohibited by applicable consumer law.

To the fullest extent permitted by law, Work-Built and its affiliates, directors, officers, employees, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, opportunities, or business interruption, arising out of or related to the Services or these Terms, regardless of the legal theory and even if advised that such damages were possible.

19Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Work-Built and its affiliates, directors, officers, employees, licensors, and service providers from third-party claims, damages, losses, liabilities, and reasonable expenses arising from your User Content, your unlawful or unauthorized use of the Services, or your material violation of these Terms or another person's rights.

Work-Built may control the defense of a covered claim, and you agree to reasonably cooperate. You may not settle a claim in a manner that admits liability for or imposes obligations on Work-Built without our written consent.

20Governing law and disputes

To be publishedAn approved dispute-resolution framework — governing law, forum, venue, and any pre-suit resolution process — will be published here before these Terms take effect.

Nothing in an approved dispute provision may prevent either party from seeking emergency injunctive relief where legally available or prevent a consumer from using a regulator, small-claims process, or other remedy that cannot lawfully be waived.

21Changes to these Terms

We may update these Terms to reflect changes to the Services, law, or our practices. We will post the updated Terms and revise the "Last updated" date.

If a change materially affects your rights, we will provide any notice and obtain any consent required by law. Changes apply prospectively from their effective date. If you do not agree to updated Terms, you must stop using the affected Services and may close your account.

22Privacy

Our Privacy Policy explains how Work-Built collects, uses, discloses, retains, and protects personal information. It is incorporated by reference only to the extent permitted by applicable law and does not reduce the privacy rights provided by law. Where required, a separate Consumer Health Data Privacy Policy will apply to covered consumer health data.

23General terms

These Terms, together with policies and additional terms expressly incorporated into them, form the entire agreement between you and Work-Built concerning the Services, except where a separate signed agreement applies.

If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. Work-Built may assign them in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law, subject to applicable law.

Section headings are for convenience only. Words such as "including" mean "including without limitation." These Terms do not create third-party beneficiary rights except where expressly stated. Neither party is responsible for delay or failure caused by events beyond its reasonable control, except for obligations that cannot lawfully be excused.
